On February 23, 2016, a Jefferson County Justice of the Peace ruled in favor of vehicle owner after his vehicle was outright illegally towed by predatory K & K Towing against the Lynd Corporation, the property management company. Amazingly, K & K’s attorney, Jonathan Bruce was present in Court representing the property management company at the expense of K & K Towing, which my all means is providing something of value to the parking facility in connection with the removal of the vehicle. The actions of JP Burnett is a classic example of Judge who needs additional training reference the Texas Towing, Storage & Booting Act and because he lacks this necessary training to avoid violating the rights of victims, we can no longer recommend this Court for the Small Claims Lawsuit for Statutory Violations, unless you request a trial by Jury.
This should serve as a reminder to all property management companies in Southeast Texas that use K & K Towing and accept their bribes, YOU will be held responsible before a Judge in Court, as victims will be pursuing criminal charges against you, per Occupations Code 2308.405.
We found it odd, the Judge would award less than the statutory limit of not less than $1000, but after several phone calls to the Court Clerk at this Court, it’s recommended the Judge change his original civil penalty as the statute states, as Judge Burnett lacks legislative or judicial authority to award a lesser amount.
